Why a will matters

Your wishes, not default rules

Without a will, your property is shared under succession law, which may not be how you would want it.

Nominee is not always the heir

A nomination does not always decide who finally inherits an account or investment. A will makes your intention clear.

Fewer disputes

Clear instructions make things easier for your family at a difficult time, and reduce the chance of arguments.

Simpler for your family

An executor and a clear list of what you own help your family find and transfer everything.

Good to know about wills in India

  • A will can be handwritten or typed, and does not need stamp paper.
  • You sign it in front of two witnesses, who also sign. They should not be people who receive anything under the will.
  • Registering a will is optional. It can add a layer of proof, but an unregistered will is valid too.
  • You can change or replace your will at any time. The latest valid will is the one that counts.
  • For Muslims, personal law applies, and a will can usually cover only up to one third of the property.

This is general information, not legal advice. For large or complex estates, businesses, property abroad or family disputes, please speak to a lawyer.

Frequently asked questions

Is a will without stamp paper valid in India?

Yes. A will does not need stamp paper. It can be handwritten or typed on plain paper, as long as you sign it and two witnesses sign it in your presence.

Does a will have to be registered?

No, registration is optional. A registered will can be harder to challenge, but an unregistered will that is properly signed and witnessed is also valid.

Who can witness my will?

Any adult of sound mind can be a witness. Avoid anyone who receives something under the will, or their husband or wife, because a gift to a witness can become invalid.

Is a nominee the same as a legal heir?

Not always. A nominee is usually the person a bank or fund house pays the money to, but depending on the asset and the law, they may have to hold it for the legal heirs. A will makes clear who you want to inherit.
